These terms are the agreement between you and us when you use Tropi Guide. By downloading the app or buying a tour, you accept them.

Who we are

What Tropi Guide is

Tropi Guide sells self-guided audio tours of Madeira. Some are walked, some are driven — each tour says which it is before you buy. You follow the route at your own pace and your phone plays narration as you reach each point, using GPS.

It is not a guided tour and there is no guide with you. Nobody is tracking where you are, nobody is expecting you at the end, and there is no group to notice if you do not arrive.

Your safety

You are responsible for your own safety at all times. Look where you are going, not at your phone. Stop walking before you read the screen.

By using Tropi Guide you accept that:

Accuracy of our content

We research our tours carefully and walk them ourselves. Even so, places change. Buildings close, streets are dug up, viewpoints are fenced off. Content is provided for interest and enjoyment, and we do not guarantee it is complete, current or free of error.

GPS is not perfect either. Narrow streets, tall buildings and cloud cover can delay or misplace a trigger. You can always play any stop by hand from the list.

Where we mention a business, a museum or a beach, we are describing it, not recommending or endorsing it, and we have no control over it. Nobody pays to be mentioned in a Tropi Guide tour.

Your account

You need an account to buy and keep tours. You must be at least 16 years old. You can sign in with Apple, Google, Microsoft, or a one-time code sent to your email. Keep whichever account you use secure: anyone who can sign in as you can use your tours.

You may delete your account at any time in Support → Account Settings → Delete My Account.

Buying tours

Tours are one-off purchases made through Apple's In-App Purchase system. Apple is the seller of record, takes the payment, and issues your receipt.

Your right to change your mind

As a consumer in the EU you normally have 14 days to withdraw from a purchase. For digital content there is an exception: once you start downloading or playing a tour, that right is lost, because you have received what you bought. By downloading or playing, you agree to immediate delivery and acknowledge this.

This does not affect your legal rights if a tour is faulty or not as described.

Refunds

Refunds for App Store purchases are handled by Apple, not by us. We cannot issue one. Request a refund at reportaproblem.apple.com.

If something is genuinely wrong with a tour, tell us anyway. We would rather fix it.

What you may and may not do with the audio

When you buy a tour we give you a personal, non-transferable licence to listen to it for your own use. You keep the licence. You do not own the recordings.

You may not:

All content, including recordings, scripts, routes, photographs and the name Tropi Guide, belongs to us and is protected by copyright.

Reviews and reports

You keep ownership of what you write, and you give us permission to show your review in the app next to the tour. Keep reviews honest and civil. We may remove reviews that are abusive, off-topic, or that contain other people's personal details.

If you attach a photograph to a problem report, you are telling us we may use it to understand and fix what you are reporting. It is not published, and it is not used for anything else. Please do not photograph other people.

Problem reports and suggestions you send us are not published. If you send us an idea, you agree that we may use it without owing you anything for it.

Availability

We try to keep the app working, but we do not promise it will be available without interruption. Tours may be updated, corrected or withdrawn. A route might close permanently, or a recording might need replacing. If we withdraw a tour you have bought, we will tell you.

Download a tour before you set out. That is what makes it work without a signal, and much of Madeira has no reliable mobile coverage.

Our responsibility, and its limits

We are responsible to you if we breach these terms or fail to use reasonable care, but only for loss that is a foreseeable result of that failure.

We do not limit or exclude our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.

Beyond that, we are not responsible for loss caused by things outside our control: how you choose to walk or drive a route, decisions you make at the wheel or on your feet, decisions you make about your own safety, the weather, the condition of roads and paths, the acts of third parties, or your phone's battery, GPS or connection failing.

Nothing here affects your statutory rights as a consumer under Portuguese and EU law.

Ending this agreement

You may stop using Tropi Guide at any time by deleting your account or the app. We may suspend or close an account that breaches these terms, in particular one distributing our audio. Where we do, we will tell you why.

Changes to these terms

We may update these terms. If a change matters to you, we will say so in the app before it takes effect. Continuing to use Tropi Guide after that means you accept the new version.

Law and disputes

These terms are governed by Portuguese law, and the courts of Portugal have jurisdiction. As a consumer you keep the protection of the mandatory rules of the country where you live.

If we cannot resolve a complaint between us, EU consumers may use the European Commission's Online Dispute Resolution platform.
